ENGAGEMENT

1. By placing an order to purchase the seminar services on the form, you acknowledge that you have read these Terms and Conditions. Upon payment and/ or signing of the contract this forms a contract between you and Creative Coaching Concepts Ply Ltd.

The Seminar is a private event for people looking to grow and improve their business strategy, hosted by Creative Coaching Concepts. During the event, as well as being provided with training and other content, attendees will be given the opportunity to purchase further training, seminar services they may find valuable. Attendees are under no obligation to purchase any product at the event and any purchases made are at the attendees’ own discretion. 

TIME AND PLACE

2. Your payment of the Investment to Creative Coaching Concepts Pty Ltd entitles you to:a. Attend the Location during the Seminar Hours to receive the Seminar Services; andb. To receive a copy of the Materials.

3. We may change the Speakers, the Hours, the Dates and/or the Location of the Seminar Services for any reason by notifying you in writing of the change and detailing substitute Speakers, Seminar Hours, Dates and/or Location and: a. Creative Coaching Concepts Pty Ltd shall have no liability to you; andb. You shall make no claim against us (including for a refund), in respect of the same.

INVESTMENT AND PAYMENT

4. You must pay to Creative Coaching Concepts Pty Ltd in consideration of the Seminar Services:a. The Investment Sum in one lump sum on the placing of the Order by you without a set off, deduction or counterclaim; orb. If Creative Coaching Concepts Pty Ltd has agreed that you may pay by Instalment, you must pay each Instalment to Creative Coaching Concepts Pty Ltd in full and without set off or deduction the Instalment Sum on the Instalment Payment Date.c. If you do not pay Creative Coaching Concepts Ply Ltd the Minimum deposit at the time of purchase, the difference between your investment and minimum deposit will be charged within 3 working days.d. Instalment due date will take place on the same date initial deposit is made, unless this falls after the 27th of the month, whereby the 27th will be used as the instalment date.

5. If you do not pay the investment sum in full, Creative Coaching Concepts Pty Ltd reserves the right to add an installment payment surcharge to the total investment sum.6. Payments made under this agreement must be made by the means specified in the Order.7. a. If Payments are not made by the approved due dates, Creative Coaching Concepts Pty Ltd reserves the right to cancel your enrollment and no refund or credit will be given. In addition to this, if services have been used, accessed or available to you, Creative Coaching Concepts Pty Ltd reserves the right to place all outstanding and overdue accounts with a debt collection agency.b. Until payment has been made in full, some or all of the seminar service and materials will be withheld until any outstanding balance is settled.

CANCELLATION RIGHTS

8. There is no cooling off period after placing an Order. If, at any time or for whatever reason, you decide you do not wish to receive the Seminar Services, you will not be eligible for a refund of any monies you have paid to us under this agreement.

TRANSFERRING TICKETS

9. a. In the event you are unable to attend the seminar service you have purchased, you can transfer this service to the next edition of the seminar service and notify Creative Coaching Concepts Ply Ltd in writing to info@creativecoachingconcepts.com.au at no additional cost.b. The seminar service is to remain and only be used by the name of the purchaser.c. Complimentary tickets to any events, including those issued as bonuses as part of your purchase, may not be transferred and are to remain in the name of the purchaser.

EVENT CANCELLATIONS / POSTPONEMENTS

10. Creative Coaching Concepts Pty Ltd may cancel / reschedule / postpone the Seminar Services for any reason. If a Seminar Service is cancelled or postponed in full or in part, Creative Coaching Concepts Pty Ltd will use its reasonable endeavours to notify you of the cancellation or postponement using the details you provided at the time of booking.

If a Seminar Service is cancelled, Creative Coaching Concepts Pty Ltd will refund you the Investment you have actually paid to us minus any reasonable administration costs (as determined by Creative Coaching Concepts Pty Ltd) within 30 days of giving you notice of cancellation.

If a Seminar Service is rescheduled or postponed, Creative Coaching Concepts Pty Ltd will, where possible, use its reasonable endeavours to offer you tickets to the rescheduled

Seminar Service equivalent to the value of the investment actually paid to Creative Coaching Concepts Pty Ltd. Any elements of the Seminar Service that have been provided to you are non-refundable. Events which are rescheduled or postponed are not eligible for a refund and Creative Coaching Concepts Pty Ltd shall have no further liability to you in respect of the cancellation, rescheduling or postponement of the Seminar Service.a. Product discounts are negotiated but may vary in future. Creative Coaching Concepts cannot be held accountable to future changes of product discounts.

For all live events a fee of $97 per day applies to every participant to cover the Day Delegate package. (As this membership is already heavily discounted)

DISCLOSURES

11. You acknowledge:a. that neither Creative Coaching Concepts Pty Ltd, any of our representatives or any person we engage to perform the Seminar Services (‘Relevant Persons’) is an investment advisor or licensed by ASIC or any other governmental authority to provide investment advice;b. that the Relevant Persons do not purport to provide investment advice or operate an investment advice business (as defined in the corporations Act 20011; and c. Creative Coaching Concepts Pty Ltd may pay commissions to third parties arising from your entering into this agreement.d. To gain entry to the training photo Identification will need to be presented at registration.

TICKET SALE AND RESALE

12. Seminar services or event tickets may not be transferred, resold (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods and services. If a seminar service or event ticket is sold or used in breach of this condition, the service may be cancelled without a refund and the bearer of the ticket may be refused admission.

Scalping warning: The resale of a seminar service or event ticket in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

FORCE MAJEURE

13. If the Seminar Services as contemplated by this Agreement are prevented or cancelled because of an act of God, an inevitable accident, fire, blackout, flood or any other calamity, or if by reason of strikes, or lockouts, or any other events beyond the direct control of both parties, then the promoter may at its option either postpone the Seminar Services from the original Seminar Services date or cancel and refund as per clause 10.

GENERAL

14. All notices or other communications must be made to info@creativecoachingconcepts.com.au15. The non-exercise of or delay in exercising any power or right of a party does not operate as a waiver of that power or right, nor does any single exercise of any power or right preclude any other or further exercise of it; or the exercise of any other power or right. A power or right may only be waived in writing, signed by the party to be bound by the waiver.16. Should any provision of this agreement be held by a Court of competent jurisdiction to be unlawful, invalid, and unenforceable or in conflict with any rule, statute, ordinance or regulation the validity and enforceability of the remaining provisions will not be affected.17. This agreement constitutes the entire agreement between the parties. Any prior arrangements, agreement, representations or undertakings are superseded.18. In these terms and conditions the following term seminar services will cover all or any of the following:a. Additional Seminarsb. Ongoing Mentoring or coachingc. Tangible productsd. Online or virtual resources19. One invoice is generated per order and communication is solely with the buyer of the product

NON-DISCLOSURE AGREEMENT

20. Client hereby acknowledges that they will be trained in material considered “trade secret” and confidential in nature. Client agrees to not disclose any, techniques, nor comments about the event of any kind to others, via forum, message boards, private emails, blogs or other venue. If Client does disclose any information about the event then they admit to damages and breach of contract and will be subject to civil litigation and damages. Client agrees to not create, nor partner nor associate with any person, any kind of product related to Creative Coaching Concepts Pty Ltd, including but not limited to USB-Files, e-books, special reports, audio or video files, public postings of content, or any other derived materials. Client shall not record any portion of the event.21. Client agrees to indentify and hold harmless Creative Coaching Concepts Pty Ltd against all loss or damage that client may suffer as a result by Creative Coaching Concepts Pty Ltd and its speakers and associates and any of its affiliates and representatives from any breach of these Terms and any other cause or alleged cause of any kind. Creative Coaching Concepts Pty Ltd reserves the right to alter terms and conditions with prior notice.
